Unique Care Agreement
This organization can act as a tax intermediary for the CPA`s CHOICE program. PCA Choice is a service option for individuals who receive BCP services through Medical Assistance (MA), PA Waiver Programs, or the Alternative Care Program. If you choose this option, the person receiving the services will hire their own personal caregivers and direct their own care. To participate, the person in need of care (or a responsible party) must designate an agency of choice from the CPA to act as a tax broker. The financial intermediary takes care of the settlement of the services of the APC in the Department of Social Services and the payment of the APC. Before a person can obtain a community care licence or provide services, work, work or live in a community care facility, they must obtain criminal record authorization from the Care Provider Management Office (CPMB). A person convicted of a crime other than minor traffic violations will be disqualified unless the California Department of Social Services (CDSS) grants an exemption from the permit requirement. All convictions, with the exception of minor traffic violations, require an exception, including offenses, crimes, and convictions that took place long ago. An exception is a written document authorized by the CDSS that „exempts“ the person from requesting the disclosure of a criminal record. The CDSS is prohibited by law from granting exemptions to persons convicted of certain offences (non-exceptional offences). Currently, there are 59 non-exempt crimes, including murder, rape, torture, kidnapping, and crimes that require the registration of sex offenders, and non-exempt crimes are listed here. If a person is convicted of a non-exempt crime, they cannot work in a licensed facility or for a health organization, and a person`s application is denied or the permit revoked because of the conviction. The CDSS also has the power and responsibility to investigate arrests to determine whether the underlying behaviour is justified and therefore poses a risk to the health and safety of clients in care.
An independent home care assistant is defined as a person who is 18 years of age or older and who is not employed by a home care organization but is registered as a home caregiver and who provides home care services through a direct agreement with a client. A home caregiver can initially apply as an independent home caregiver, and the home care organization can request a transfer of the home caregiver`s release or criminal record exemption once the home caregiver is registered in the Home Caregiver Registry. Under the CPA Choice Option, the person who needs care is responsible for :* Entering into a written agreement with the CPA Organization of Choice* Finding, hiring/firing and training CPA employees* Developing a care plan, if necessary with the assistance of qualified professionals* Monitoring and evaluating CPA employees* Providing CPA relief personnel* Planning CPA staff* Monitoring CPA staff The Manual of the contract supplier is a document that describes the responsibilities and requirements for the provision of services for the network of contract suppliers. It is divided into thirteen individual sections relating to the specific levels of care available to children and adolescents through contractual relationships between DCS and contract provider agencies. The BCP Agency of Choice (Tax Investigator) is responsible for :* Request a criminal audit for BCP employees and qualified professionals* Register BCP employees with DHS* Billing for CPA and qualified professional services* Maintain the required liability insurance for CPAs and qualified professionals* Maintain written agreements for all CPA employees, qualified professionals and responsible parties* Payment and Withholding Tax for CPA employees and qualified professional associations and individual practitioners who provide maximum choice and control to individuals who use services or other forms of support to assist them in their daily activities (including the ability to select, manage and dismiss their employees). It should be noted that situations may arise where there are discrepancies or ambiguities in the application of the guidelines contained in the PMO. In such situations, DCS`s current policy replaces the elements and requirements contained in the most recent version of the Contract Provider`s Guide. According to the state health commissioner`s order issued on September 28, 2021, all registered home care assistants must receive the first dose of a one-dose diet or the second dose of a two-dose diet of a currently approved covid-19 vaccine by November 30, 2021. Exceptions are only available on the basis of religious beliefs or qualified medical reasons, and exempt individuals must undergo weekly tests. Affiliated home care aides must provide their home care organizations with proof of vaccination or exemption and test results, and independent caregivers must keep their own immunization or exemption records and test results.

If the person does not have a criminal history, the DOJ sends a notice of release to the applicant or licensee and to the CPMB. If the person has a criminal past, the DOJ sends a transcript of the criminal record to the CPMB showing the arrests and convictions. .
